1. Acceptance of Terms

By accessing or using the services provided by BrainEscape 369, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

BrainEscape 369 provides done-for-you digital marketing and AI automation services for local service businesses, including:

• •Social Media Management — content creation, scheduling, and posting across platforms including Facebook, Instagram, LinkedIn, Google Business Profile, TikTok, YouTube, Pinterest, Threads, and Bluesky.
• •Review Management — automated review generation and reputation monitoring.
• •AI Voice Receptionist — AI-powered call handling, lead qualification, and appointment booking.
• •Smart Automation Systems — multi-channel lead nurturing via email, SMS, and voice.

3. Service Plans & Billing

Services are offered on a month-to-month subscription basis at the following rates:

• •Starter Plan: $497/month
• •Growth Plan: $797/month
• •Pro Plan: $1,197/month

Billing is processed monthly on the date of enrollment. No long-term contracts are required. You may cancel at any time with written notice to info@brainescape369.com before your next billing cycle.

4. No-Contract & Cancellation Policy

BrainEscape 369 operates on a month-to-month basis. There are no long-term commitments or cancellation fees. To cancel, notify us in writing at least 5 business days before your next billing date. Services will remain active through the end of the paid billing period.

5. Client Responsibilities

By using our services, you agree to:

• •Provide accurate business information and access credentials necessary to deliver services.
• •Maintain the confidentiality of any shared login credentials.
• •Grant BrainEscape 369 authorized access to your social media and business accounts solely for the purpose of delivering contracted services.
• •Comply with all applicable platform terms of service (Meta, LinkedIn, Google, etc.).
• •Not use our services for spam, fraud, or any unlawful purpose.

6. Client Account Access

To deliver social media management services, clients may be required to grant BrainEscape 369 access to their social media accounts and business profiles. This access is used exclusively to create, schedule, and publish content on your behalf. Access will be revoked upon cancellation of services.

7. Data Usage & Privacy

Your personal and business information is governed by our Privacy Policy. By using our services, you consent to the collection and use of data as described in that policy.

8. Third-Party Platforms

Our services operate in connection with third-party platforms including but not limited to Meta (Facebook/Instagram), LinkedIn, Google, TikTok, YouTube, Pinterest, Threads, and Bluesky. BrainEscape 369 is not responsible for:

• •Downtime, policy changes, or service interruptions on third-party platforms.
• •Algorithm changes that affect content reach or performance.
• •Content moderation decisions made by third-party platforms.

Use of these platforms is subject to their respective terms of service.

9. Intellectual Property

All strategies, systems, templates, workflows, and proprietary content developed by BrainEscape 369 remain the intellectual property of the company. Content created specifically for your business profile belongs to you upon payment.

10. Results Disclaimer

BrainEscape 369 makes no guarantees of specific results including follower growth, lead volume, or revenue. Social media and digital marketing results vary based on industry, market conditions, and platform algorithm changes outside our control.

11. Limitation of Liability

BrainEscape 369 shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services, including losses resulting from third-party platform outages, algorithm changes, or force majeure events. Use of our services is at your own risk.

12. Service Modifications

We reserve the right to modify or discontinue any service offering at any time. Clients will be notified of material changes with reasonable advance notice.

13. Termination

BrainEscape 369 reserves the right to suspend or terminate services for violations of these terms, abusive behavior, fraudulent activity, or non-payment. Clients may cancel at any time per Section 4.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
